The family has covered the crime scene. It's where they say the victim, Travis Thigpen, fell to the floor after being shot in the arm by a Fort Deposit Police officer.
"He had is hands up right here. He goes to drop his hands down and he told him, 'Get on the floor! Get on the floor!' And when goes to drop his hands he just shot him," Said Stanley Wade Simmons, the girlfriend's step-father who tells us he witnessed what happend.
It happened early Monday morning at this Fort Deposit home on County Road 45. Simmons, who lives with Thigpen, says it all started as a domestic dispute between his step-daughter and Thigpen. That's when the police were called.
From inside the house, he says an officer demanded Thigpen put his hands in the air. Another family member, Tykesha Caldwell, says she also witnessed what happened. She says she saw the officer shoot Thigpen.
"He did everything he told him to. He held his hand up and told him to get down on the floor. He was getting down on the floor and all of a sudden he just shot him and I just panicked because I was standing right beside the officer and I'm like, 'Why did you do that? Why did you even pull a gun out?'" Said Caldwell.
The family says Thigpen was then taken to LV Stabler Hospital in Greenville and later transferred to Baptist South Hospital in Montgomery.
"Because this is an on-going investigation, by law details cannot be released until the case is disposed of properly. Once the investigation is complete, the ABI will turn over their findings to the District Attorney for review," Said Alabama Department of Public Safety spokesperson, Sgt. Steve Jarrett.
Alabama News Network tried to speak with the Fort Deposit Mayor, but he was out of town. And Fort Deposit Police is not releasing any information other than the officer involved is on paid administrative leave throughout the investigation.
UPDATE: Thigpen's family tells Alabama News Network that a bullet is lodged near his underarm, leaving him with a broken arm. They say he is in stable condition and should be released from the hospital sometime Tuesday.

ABI has now taken over this investigation after agents tell Alabama News Network there was a shooting at a Fort Deposit home. The home belongs to the victim's girlfriend and her family and they are speaking out about what happened.
